Part 2 Prohibition of disability discrimination Division 5 Exemptions Section 49 49 Charities This Part does not: (a) affect a provision (whether made before or after the commencement of this Part) of the governing rules (within the meaning of the Australian Charities and Not-for-profits Commission Act 2012) of a registered charity, if the provision: (i) confers benefits for charitable purposes; or (ii) enables such benefits to be conferred; wholly or in part on persons who have a disability or a particular disability; or (b) make unlawful any act done to give effect to such a provision. 51 Pensions and allowances (1) This Part does not affect discriminatory provisions relating to pensions, allowances or benefits in: (a) the Defence Service Homes Act 1918; or (b) the Papua New Guinea (Member of the Forces Benefits) Act 1957; or (d) the Social Security Act 1991 or a legislative instrument made under that Act; or (da) the Social Security (Administration) Act 1999 or a legislative instrument made under that Act; or (db) the Social Security (International Agreements) Act 1999; or (e) the Veterans’ Affairs Legislation Amendment Act 1988; or (f) the Veterans’ Entitlements Act 1986; or (g) the Veterans’ Entitlements (Transitional Provisions and Consequential Amendments) Act 1986; or (h) the Military Rehabilitation and Compensation Act 2004; or (i) the Military Rehabilitation and Compensation (Consequential and Transitional Provisions) Act 2004; or (j) the Safety, Rehabilitation and Compensation (Defence-related Claims) Act 1988. 42 Disability Discrimination Act 1992 Compilation No. 33 Compilation date: 12/4/18 Authorised Version C2018C00125 registered 19/04/2018 Registered: 19/4/18
