Prohibition of disability discrimination Part 2 Offences Division 4 Section 43 (f) has reasonably asserted, or proposes to assert, any rights of the person or the rights of any other person under this Act or the Australian Human Rights Commission Act 1986; or (g) has made an allegation that a person has done an act that is unlawful by reason of a provision of this Part; or on the ground that the first-mentioned person believes that the other person has done, or proposes to do, an act or thing referred to in any of paragraphs (a) to (g) (inclusive). 43 Offence to incite doing of unlawful acts or offences It is an offence for a person: (a) to incite the doing of an act that is unlawful under a provision of Division 1, 2, 2A or 3; or (c) to assist or promote whether by financial assistance or otherwise the doing of such an act. Penalty: Imprisonment for 6 months. 44 Advertisements (1) It is an offence for a person to publish or display, or cause or permit to be published or displayed, an advertisement or notice that indicates, or could reasonably be understood as indicating, an intention by that person to do an act that is unlawful under a provision of Division 1, 2, 2A or 3. Penalty: 10 penalty units. (2) For the purposes of subsection (1), advertisement includes every form of advertisement or notice, whether to the public or not, and whether in a newspaper or other publication, by television or radio, by display of notices, signs, labels, show cards or goods, by distribution of samples, circulars, catalogues, price lists or other material, by exhibition of pictures, models or films or in any other way, and the reference in that subsection to publish or display, in relation to an advertisement, is to be construed accordingly.
