Part II Australian Human Rights Commission Division 5 Administrative provisions Section 40 (2) The Minister may grant to a person appointed as a part-time member leave of absence from a meeting of the Commission. 40 Resignation An appointed member may resign from the office of member by writing signed by the member and delivered to the Governor-General. 41 Termination of appointment (1) The Governor-General may terminate the appointment of a member by reason of misbehaviour or physical or mental incapacity. (2) If: (a) a member becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with creditors or makes an assignment of remuneration for their benefit; (b) a full-time member engages, except with the approval of the Minister, in paid employment outside the duties of the office of member; (c) a full-time member is absent from duty, except on leave of absence, for 14 consecutive days, or for 28 days in any period of 12 months; (d) a part-time member is absent, except on leave granted by the Minister in accordance with subsection 39(2), from 3 consecutive meetings of the Commission; or (e) a member fails, without reasonable excuse, to comply with section 29 of the Public Governance, Performance and Accountability Act 2013 (which deals with the duty to disclose interests) or rules made for the purposes of that section; the Governor-General shall terminate the appointment of that member. 50 Compilation No. 48 Australian Human Rights Commission Act 1986 Compilation date: 20/12/18 Authorised Version C2019C00030 registered 14/01/2019 Registered: 14/1/19
