Under the Care Centres Act 1993, the term “care” includes protection, supervision, rehabilitation and training.20 ‘Care centre’ is defined as a residential care and a day care centre. The Act does not apply to: 1. 2. 3. 4. 5. any government hospital, or any private hospital licensed under the Private Hospitals Act 1971 [Act 43]; any institution or premises subject to control under, and lawfully established, registered, operated, or managed in accordance with, the Education Act 1961 [Act 43 of 1961]; any child care centre registered under the Child Care Centres Act 1984 [Act 308]; any institution or premises for the treatment, rehabilitation, or after care of drug dependants, lawfully established or operated under the Drug Dependants (Treatment and Rehabilitation) Act 1983; any institution or premises operated or managed by the Federal Government or a State Government; or any institution or premises used by the Federal Government or a State Government for the temporary housing or care of persons on the occurrence of any event which gives rise to an emergency, or in the interests of public safety.21 19. Therefore, as long as a care centre comes within the definition of the Act, it is required to be registered.
