NATIONAL HUMAN RIGHTS COMMISSION
United Nations Convention on
the Rights of the Child(UNCRC)
Provisions in the Constitution of India and
Domestic Legislation/Policy Measures in
Consonance with UNCRC
Judgements
9) M C Mehta vs the State of Tamil Nadu and others
(W.P. (C) 465/1986) is a historic judgement on child
labour, which elaborated the situation of child labour in
India. . The judgement highlighted the relation between
poverty and child labour and also shed light on how the
state has failed to eradicate child labour, and its lack
of zeal to deal with it. The court reiterated that there
should be regular survey of child labour.
Gaps between UNCRC
& Indian Laws (G) and
Recommendations(R)
G15: Many hazardous occupations
have been removed from the list
given in the Part A of the Schedule
to CLPRA.
R15: Ministry of Labour and
Emploment should review and
update the list of “Hazardous
occupations and processes” at
regular intervals, based on the
emerging global commitments and
trends.
G16: Regular surveys of prevalence
of child labour as mandated by the
Supreme Court are not being conducted and as such, the practice of
child labour is continuing and there
is no data (including sector/industry
wise) available which takes away
the scope of targeted interventions
to eliminate child labour.
