KL INQUIRIES INTO COMPLAINTS (a) Detention under Preventive Laws Articles 9 and 10 of the UDHR guarantee that no one is to be subjected to arbitrary arrest, detention, or exile and that everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal of any criminal charge against him. During the year the Commission received 25 complaints regarding detention under the Prevention of Crime Act 1959 (POCA), seven complaints regarding detention under the Dangerous Drugs Act (Special Preventive Measures) 1985 (DDASPM) and three complaints regarding detention under the SOSMA. As of 31 December, 432 were detained under POCA at Pokok Sena, Bentong, Kluang, Simpang Renggam and Bintulu Prisons; 1428 were detained under preventive detention of DDASPM at Batu Gajah, Muar, Simpang Renggam and Machang Prisons; and 16 were detained under POTA at Simpang Renggam and Machang Prisons.21 21 The information was made available to the Commission by Prison Department of Malaysia 50 SUHAKAM ANNUAL REPORT 2016 suhakam 2new.indd 50 3/23/17 5:54 PM
