3.5 Recommendations for Compensation
NHRC’s Step on detention of innocent people in Jail
The police had arrested the victims only because their names matched with the
accused people in different cases. Barrister Abdul Halim, Chairman, CCB
Foundation drew attention of NHRC on media reports about this incident. The
Commission has asked the Security Services Division, Ministry of Home Affairs to
send report after investigation. The Security Services Division sent report that 10
innocent persons are detained in 08 prisons because their names matched with the
accused persons. Among them, 09 persons were freed. NHRC believes that due to the
fault of Police, these person’s human rights were violated. On 21 July 2022, NHRC
full bench chaired by Nasima Begum, ndc gave verdict on this case with the
following recommendations:
1. The Commission recommended payment of Tk 5 Lakh to the mother of Mizanur
Rahman, one of the 10 victims, who was confined in Jashore Central Jail. Mizan
died in a hospital on February 10, 2020 after he was freed from Jail on January 22,
a day after he was sent to Jail. In city scan report, injury in his head was found.
NHRC also recommended payment of Tk 50,000 as compensation to each of the
nine other victims, who were confined in Jails for two to three months. The
Commission asked the Ministry of Home Affairs to implement the
recommendations and submit a compliance report to it.
2. One person, Jwel Rana is supposed to be confined in Jail willingly for money. This
should be investigated and NHRC recommended Inspector General of Police to
investigate the matter and take legal action if found true.
3. The wrongful confinement in Jail is occurring frequently in Khulna region. So,
MOHA is recommended to give necessary instruction to relevant Police
Commissioner and DIG to keep special surveillance in that region.
4. Secretary of Security Services Division is recommended to investigate if innocent
people are being detained in Jails based on wrong information.
5. IGP is recommended to give necessary recommendations to Police for not giving
any derogatory name for easily identifying perpetrators.
6. Secretaries of both divisions of MOHA are recommended to take actions for
implementing these recommendations.
NHRC’s action on allegation of death in Police Custody
Media reported that Samsul Alam, a businessman had died in police custody in Pirganj,
Rangpur. Police Super of Rangpur had been asked to send report. As per their report,
