Annual Report 2008-2009 forces undoubtedly are performing a very onerous duty in Jammu & Kashmir by operating in difficult terrain to fight terrorism at the cost of risking their own lives. It further observed that though the fight of army personnel against the terrorists deserves all support, the State Government has a duty to ensure that no harm is caused to innocent citizens. 4.88 Since the allegations were substantiated in the magisterial enquiry and later on by police investigation, the Commission vide its proceedings dated 28 January 2009 recommended to the Ministry of Defence to pay a sum of Rs. 3, 00,000 as monetary relief to the next of kin of Javed Ahmed Magrey. The Secretary, Ministry of Defence was asked to submit a compliance report along with the proof of payment within eight weeks. The compliance report from the Ministry of Defence is awaited. f) Communal Violence 18. Violence Against Christians in Seven Districts of Karnataka (Case No. 336/10/1/2008-2009) 4.89 The Commission received a complaint from one Dr. Sajan George, President of Global Council of Indian Christians, Bangalore. In the complaint, Dr. George had expressed concern about the fundamentalist attack on Christians and their institutions in the State of Karnataka. A list of 96 incidents in which the Christians were attacked by Hindus or their places of worship were desecrated or damaged was furnished by him. He thus urged the Commission to ensure protection and appropriate relief to the minority Christian community of Karnataka. 4.90 Taking cognizance of the matter, the Commission called for a factual report from the Government of Karnataka. It also directed the Investigation Division to enquire into the incidents. 4.91 The team deputed by the Investigation Division of the Commission inquired into 44 incidents, spread over seven districts of Karnataka, namely, Dakshin Kannada, Bangalore, Udipi, Chickmagalur, Chickballapur, Tumkur and Kolar districts. 4.92 The team found that after the murder of Swami Laxmnanda Saraswati in Kandhamal district of Orissa, the Christians in Karnakata were simultaneously attacked and their churches and prayer halls were damaged or desecrated. In many cases, the police registered criminal cases, but in some cases, the registration of FIRs was delayed or an effort was made by the police to dilute the gravity of offences. The team found that there were instances where the police played a partisan role and instead of taking action against the miscreants, booked the victims. The inquiry report highlighted cases where no compensation was given at all or the relief given was not in proportion with the degree of loss. It also observed that the State Government made an effort to play down the incidents. The team made several recommendations to foster a sense of security among the minority community. 42
