Annual Report 2008-2009 4.68 A complaint was made by one of the opposition parties of Uttar Pradesh against the policies and misuse of powers by officials and other functionaries of Government of Uttar Pradesh. The complaint highlighted two incidents, one that had taken place in K.K.C. Degree College in Lucknow on 8 January 2008; and the other in front of Chaudhary Charan Singh College in Saifai Village, Etawah District on 9 January 2008. 4.69 On 8 January 2008, a function was organized in K.K.C. Degree College wherein two ministers from the State Government were invited as Chief Guests. On their arrival, some of the students started shouting slogans demanding restoration of student union elections in all the colleges of Uttar Pradesh, which had been banned by the existing State Government. On the orders given by the two Ministers, the police started beatingup the students, many of whom were injured. The seriously injured students were admitted in government hospitals but without giving them proper treatment, they were forcibly taken away by the police to the jail. Later when senior leaders of the concerned political party, along with their followers went to the bungalow of the Senior Superintendent of Police with a request that the injured students be given proper treatment, the police not only attacked them but also misbehaved with the leaders. 4.70 On the following day, that is on, 9 January 2008, there was a road blockade by the people of Saifai village in front of Chaudhary Charan Singh College (Hainwra College). The public had gathered to protest against the high-handedness of the State Police in the incident that had taken place on 8 January 2008 in Lucknow. Some of the students standing inside the college compound were watching the activities taking place on the road through the college gate, which was locked. The Senior Superintendent of Police, Etawah, along with his team, reached the spot and ordered firing of tear gas shells as well as lathi charged on the innocent public who were part of the peaceful blockade. During this incident, three students received bullet injuries, out of which one student, named Mukesh, s/o Shri Ram Singh, who was pursuing graduation, died of bullet injury. 4.71 Sh. Ram Gopal, a Peon of Chaudhary Charan Singh College went to Saifai Police Station to lodge an FIR against the Senior Superintendent of Police, Etawah and other officials. But, no FIR was registered at Saifai Police Station. On the contrary, the police lodged an FIR against the Principal and 500 students of Chaudhary Charan Singh College (Hainwra College). 4.72 On the directions of the Commission, a team of officers from the Investigation Division of NHRC conducted an enquiry and subsequently also submitted its report. 4.73 On consideration of the report submitted by the Investigation Division, the following was stated by the Commission: “The NHRC’s investigation team has disbelieved the police version that the students indulged in stone pelting. As per the enquiry report, six students were injured in the lathi charge by the police.They were taken to Balrampur hospital for treatment, but they were got discharged by 38
