Death of a Child Born in Agra Jail due to Non-availability of Basic Minimum Facilities (Case No.24687/24/2006-2007) 4.29 Bobby, a woman prisoner was admitted in District Jail, Agra on 20 June 2006. She was in an advanced stage of pregnancy. She delivered a female child on 23 August 2006 in the jail. On 17 September 2006 the child became ill and died. 4.30 On consideration of magisterial enquiry report, the Commission found that the child was born in the toilet of the prison and neither the mother nor the child was given nutritious diet. The Commission recommended to the State Government to pay a sum of Rs. 1,00,000 as monetary relief to the bereaved mother. It also emphasized the need to provide basic minimum facilities in jails for delivery of children as well as for providing pre-natal and post-natal care to the mother and the child. 4.31 The compliance report and the proof of payment are awaited. 8. Death of Undertrial Prisoner Mangal Singh due to Improper Diet in Baripada Jail, District Mayurbhanj, Orissa (Case No.502/18/2004-2005-CD) 4.32 The case pertains to a death of one undertrial prisoner named Mangal Singh in judicial custody. According to the post-mortem report, the death was caused on account of “acute gastroenteritis due to disseminated tuberculosis”. Though, the magisterial enquiry conducted in the case did not suspect of any foul play, it was however observed by the Commission that when the loss of weight in the prisoner was noticed by the doctor on 29 July 2004, he should have been immediately admitted in the District Hospital, Baripada for special treatment. It was also observed by the Commission that the diet scale prescribed for the undertrial prisoners at the rate of Rs.19 per day in Baripada jail was paltry and insufficient. A balanced diet to a TB patient cannot be provided with the prescribed scanty amount. 4.33 The Commission thus directed for a detailed enquiry which led to the delay in referring the undertrial prisoner to the State District Hospital and also directed the State Government to look into the matter relating to the increase in the diet scale of the prisoners. 4.34 The Inspector General of Prisons, Orissa vide his communication dated 22 June 2007 reported to the Commission that a thorough and careful enquiry had been conducted and the same revealed that there was no intentional neglect either on the part of any jail or district hospital authorities. As regards the matter relating to enhancement of the diet scale of prisoners was concerned, it was reported by the Inspector General of Prisons that the same has been considered by the State Government and accordingly the amount of diet has been increased from Rs. 19 to Rs. 34 per day. 4.35 On being satisfied by the report that the death of undertrial prisoner Mangal Singh was a case of natural death, the case was closed by the Commission. 32
