No one shall have the right to limit human rights and freedoms, or restrict such rights and
freedoms, except in cases provided for by the Constitution and laws.
The citation in the Constitution and laws of certain human and civil rights and freedoms shall
not be used to deny or diminish other rights and freedoms thereof.
Article 27. Human and civil rights and freedoms shall be directly applicable. They shall
determine the meaning, content and application of laws, the activities of the legislative and
executive authorities and local self-government, and shall be provided with justice.
Article 28. Turkmenistan shall guarantee the equality of human and civil rights and freedoms
and the equality of man and citizen before the law and the court regardless of nationality, skin
colour, sex, origin, property and official status, place of residence, language, attitude to
religion, political beliefs, or other circumstances.
Article 29. A man and a woman in Turkmenistan shall have equal rights and freedoms as
well as equal opportunities for their realization.
Violation of equality based on sex shall entail liability established by law.
Article 30. The exercise of rights and freedoms must not violate the rights and freedoms of
others, as well as moral norms, the requirements of the law, public order, cause damage to
national security.
Article 31. Everyone shall have the right to the protection of honour and dignity.
Nothing can be the basis for the humiliation of the dignity of the individual.
Article 32. Everyone shall have the right to life and the freedom to exercise it. No one can be
deprived of the right to life. The right of every person to a free life shall be protected by the
state based on the law.
The death penalty shall be abolished in Turkmenistan.
Article 33. A person cannot be convicted or punished except in strict accordance with the
law.
No one may be subjected to torture, the use of violence, cruel, inhuman or degrading
treatment or punishment, as well as be subjected to medical, scientific or other experiments
without his consent.
A person can be arrested only if there are grounds precisely specified in the law by a court
order or with the approval of a prosecutor. In cases that are urgent and precisely specified in
the law, the authorized state bodies shall have the right to temporarily detain a person.
