Article 61. Everyone shall have the right to demand compensation in court for material or moral damage caused to him by illegal actions of state authorities, other organizations, their employees, as well as individuals. Article 62. A person cannot be forced to give evidence and explanations against himself and close relatives. Evidence obtained as a result of mental or physical influence, as well as other illegal methods, shall have no legal force. Article 63. The state shall guarantee every person the right to receive legal aid. In cases stipulated by law, legal assistance shall be provided free of charge. Article 64. A law that aggravates the situation of a citizen shall have no retroactive effect. No one can be held responsible for actions that were not recognized as an offense at the time of their commission. Article 65. The exercise of certain rights and freedoms of citizens provided for by this Constitution may be restricted only under the conditions of a state of emergency or martial law in the manner and within the limits established by the Constitution and laws. SECTION III. SYSTEM OF STATE AUTHORITIES IN TURKMENISTAN CHAPTER I. GENERAL PROVISIONS Article 66. The President of Turkmenistan, the Mejlis of Turkmenistan, the Cabinet of Ministers of Turkmenistan and the Supreme Court of Turkmenistan shall exercise the highest state power in Turkmenistan. Article 67. Local state power shall be exercised by local representative and executive bodies in accordance with the procedure established by the Constitution and laws of Turkmenistan. CHAPTER II. PRESIDENT OF TURKMENISTAN Article 68. The President of Turkmenistan shall be the head of the State and executive branch of power, the highest official of Turkmenistan, act as a guarantor of the state independence and the status of permanent neutrality of Turkmenistan, its territorial integrity, respect for the Constitution, human and civil rights and freedoms and fulfilment of international obligations. Article 69. A citizen of Turkmenistan, who was born in Turkmenistan, is at least 40 years old, speaks the state language, has been permanently residing and working in Turkmenistan for the previous fifteen years may be elected President of Turkmenistan.
