NATIONAL HUMAN RIGHTS COMMISSION, INDIA 30. Non-payment of insurance claim to a widow in respect of her deceased husband, a postman who passed away while on duty. (Case No. 15966/24/48/2016) i. The Commission received a complaint from one Shanti Devi w/o Late Manohar Lal Kashyap, Sitapur, UP, stating that her husband, Manohar Lal, who was Postman in the Postal Department died on 29.12.2001. But despite running from pillar to post, the insurance claim was not paid by the postal department. A prayer has been made for intervention by the Commission. ii. In response to notice, the AD (Legal Cell), Office of the CPMG, UP Circle, Lucknow had submitted that the payment of CGEGIS has been made to the petitioner on 03.08.2016. iii. The Assistant Director, Legal Cell, CPMG Office, Uttar Pradesh Circle, Lucknow, further submitted that there was delay in payment of terminal benefits in respect of the deceased Postman to his wife and departmental action was initiated against the delinquent employees of the Postal Department. The names S/Shri Vivek the then Sub Divisional Central Inspector, Sitapur, Ram Pal, Sub Divisional Central Inspector, Sitapur, Sachender Singh, the then Accountant, Sitapur H.O. and J.P. Yadav, the then Office Assistant (Receipt/ Dispatch), Divisional Office, Sitapur and Assistant Postmaster, Sitapur H.O. were found negligent on the matter. Two of the delinquents, namely, Ram Pal and J.P. Yadav were dealt with and punished departmentally, while action was being taken against the remaining two delinquents. iv. The Commission considered the matter on 24.11.2017 when it observed and directed as under :“The petitioner, Smt. Shanti Devi had alleged that her husband Manohar Lal had died on 29.12.2001, but, she was not paid her dues towards CGEGIS claims. The petition was received in the Commission on 07.05.2016. As per report, the dues were paid to the petitioner after considerable delay on 03.08.2016. It has been reported that out of four indicted officers, two have already been dealt with and punished departmentally. The inaction and inordinate delay on the part of the Postal authorities in payment of dues to the wife of their late employee has resulted in violation of human rights of the petitioner by the public servants. In these circumstances, a Notice under Section 18 of the Protection of Human Rights Act, 1993 be sent to the Chief Postmaster General, Uttar Pradesh Circle, Lucknow to Show Cause within six weeks as to why an amount of Rs. 25,000/- (Rupees Twenty Five Thousand) as interim relief may not be recommended to be paid to the petitioner”. 70 v.
