The report concluded that the fatal electrical accident of deceased Kuni Dakua occurred primarily due to total negligence on the part of the Southco field officials as they failed miserably to maintain their installation in a condition free from danger. 22. iii. The Commission considered the matter on 02.11.2018 and inter alia observed that the report of Executive Engineer-cum-DEI, Ganjam, Chhatrapur clearly established that the fatal accident occurred due to total negligence on the part of the Southco Field Officers as they failed to maintain their installation in a condition free from danger. The State, therefore, is liable to compensate the NOK of the deceased for violation of her right to life. iv. In view of the above, the Commission issued a notice u/s 18 (a) (i) of the PHR Act, 1993 to the Chief Secretary, Govt. of Odisha directing him to show cause within four weeks as to why the Commission should not recommend compensation of Rs.200,000- to the NOK of the deceased Kuni Dakua who lost her life because of the negligence of the officials of the electricity department. v. The Commission considered the matter on 1.1.2019 and observed that in response to the Show Cause Notice, the Addl. Secretary, Department of Energy, Government of Odisha had sent the same report which was already considered by the Commission and thereafter the recommendations for payment of compensation were made. vi. The Commission, therefore, directed the Chief Secretary, Government of Odisha once again to pay a compensation of Rs. 2 00,000 to the NoK of the deceased Kuni Dakua who lost her life because of the negligence of the officials of the Electricity Department. He will submit the Compliance Report along with proof of payment. Electrocution death of Smt. Surati Devi, aged 55 years, when she came in contact with the snapped charged phase due to the negligence of the maintenance staff of Electricity Department. (Case No. 28294/24/15/2016) 60 i. The Commission received a complaint from Shri R. H. Bansal, a human rights activist who drew the attention of the Commission towards an incident in which, Smt. Surati Devi, aged 55 years died due to electrocution while working in the field when she came in contact with a snapped high tension wire. ii. Pursuant to the directions of the Commission, the Director, Electrical Safety, Uttar Pradesh, Lucknow, has forwarded an inspection report wherein it is stated that during inspection, it was found that on 10.10.2015, a phase of overhead line snapped and fell down. Smt.Surati Devi, who was irrigating her fields, came in contact with the snapped charged phase and died due to electrocution.
