Death of one Dilip Kumar Das, Kalahandi, Odisha due to electrocution when he came into contact with a snapped live conductor lying on the road due to negligence of Electricity Department. (Case No. 2217/18/13/2018) 21. i. The Commission received a complaint from Shri Dilip Kumar Das, Kalahandi, Odisha drawing the attention of the Commission towards an incident of electrocution death of a senior citizen Bhikari Guru of Village Gopapolli under PS Ainthapali area of District Sambalpur, Odisha on 15.04.2018 when he came into contact with a snapped live conductor lying on the road due to negligence of officials of department of energy of Government of Odisha. ii. Pursuant to the directions of the Commission,the Addl. Secretary, Department of Energy, Government of Odisha, has sent a report stating that the fatal accident of Bhikari Guru occurred on 15.04.2018 at 5 am near a small irrigation canal on the outskirts of Village Gopapalli where charged conductor of LT live had snapped and fell on the road across small irrigational canal. The victim Bhikari Guru had gone to pluck flowers and came in contact with live snapped LT conductor and got electrocuted. The accident occurred due to lack of protection system at the sub-station and non-observance of safety regulations by WESCO utility. The authority of WESCO is responsible for the accident as they did not maintain the sub-station line property as per CEA Regulations, 2010. iii. The Commission considered the matter on 06.12.2018 has inter alia observed that since the occurrence took place due to lack of protection system at the sub-station and nonobservance of safety regulations by WESCO utility resulting in death of victim Bhikari Guru. Certainly his human rights were violated due to the negligence of the officials of department of energy, Government of Odisha for which the Government of Odisha is vicariously liable to make reparations to the next-of-kin of the deceased Bhikari Gurul. iv. In view of the above, the Commission issued a notice u/s 18(a)(i) PHR Act, 1993 to the Government of Odisha through its Chief Secretary requiring it to show cause within 6 weeks as to why the Commission should not recommend a monetary relief of Rs.100,000/to the next-of-kin(NOK) of the deceased Bhikari Guru. Death of one 40-year old lady Kuni Dakua in a fatal electrical accident at Chhatrapur, Ganjam, Odisha. (Case No. 4804/18/5/2017) i. The Commission received a complaint from Shri Dilip Kumar Das, Kalahandi, Odisha drawing the attention of the Commission towards an incident where one 40-year old lady Kuni Dakua died due to electrocution on 13.10.2017. ii. Pursuant to the directions of the Commission, the Addl. Secretary, Department of Energy, Govt. of Odisha has submitted a report along with the enquiry report of Executive ANNUAL REPORT 2018-19 59
