NATIONAL HUMAN RIGHTS COMMISSION, INDIA were identified as Krishna Hanse @ Nilip Enghi, Sedong Ronghang, Longpangsing Phangcho, Dhani Terang and Cholangdo @ Raju Killing. The Commission on 18.05.2012 took cognizance of the intimation and called for requisite reports from concerned authorities. According to the post mortem report, the cause of death was opined to be hamorrhagic shock as a result of gunshot injuries. 15. ii. The magisterial enquiry of the incident was conducted by SDM (Civil), Bokajan Sub Division, Bokajan, Karbi Anglong. The Magistrate on examination of the statement of the witnesses and other evidence held that on 20.4.2012, a joint team of Army, Police & COBRA (CRPF) were fired upon by the alleged KPLT militants who were hiding in a house of village Singar Basti of Borpung area. In self defense the security force also retaliated and in the ensuing encounter five militants were killed. Huge quantity of arms and ammunition were also recovered from the possession of the five deceased persons. The ballistic examination report of the seized weapons indicated that they were used for firing prior to its receipt in the FSL. The report received from Ministry of Defence, Govt. of India indicated that the five KPLT militants died in a bonafide army operation and there was no violation of human rights of the deceased persons in this case. iii. Upon a careful examination of the various reports available on record, the Commission drew an inference that the five deceased persons were eliminated by the joint operation team of Army and local police in an extra judicial manner. For this gross violation of human rights, the Commission vide its proceedings dated 15.03.2018 issued a notice u/s 18 of the Protection of Human Rights Act, 1993 to the Govt. of Assam requiring it to show cause as to why an amount of Rs. Five Lakhs each be not recommended to be paid to the NoK of the five deceased persons as mentioned above. iv. No reply to the Show Cause Notice was received inspite of reminder dated 17.07.2018. Under these circumstances, the Commission vide its proceedings dated while presuming that the Govt. of Assam had nothing to urge in the matter, confirmed the Show Cause Notice and recommended to the Govt. of Assam to pay an amount of Rs. Five Lakhs as monetary compensation to the NoK of the five deceased persons. Compliance report along with proof of payment is still awaited. The Commission took suo motu cognizance of a news report published in the English daily ‘The Hindu’ dated 07.04.2015 reporting therewith that five under trial militants were shot dead by the Telangana police while returning from the court.
