Illegal detention and false implication of one Shri Anirudh Prasad Verma S/o Shri Hardwar
Prasad Verma, resident of village Pakra Dewariya, PS Nanpara, District Bahraich, Uttar
Pradesh, by the Police of PS Risiya, Bahraich, Uttar Pradesh.

i.
The Commission received a complaint from Shri Anirudh Prasad Verma S/o Shri Hardwar
Prasad Verma, resident of village Pakra Dewariya, PS Nanpara, District Bahraich, Uttar
Pradesh, alleging that on 27.06.2015, at 2300 hours, his son Lekhraj was picked up by
the Police of PS Risiya, Bahraich, Uttar Pradesh from his house. He apprehended that the
Police may implicate his son in some false case or kill him in fake encounter. He had prayed
for the release of his son from the custody of the Police.

Pursuant to the directions of the Commission, the Deputy Inspector General, Devipatan
Range, Gonda, Uttar Pradesh,forwarded an enquiry report of the Additional Superintendent
of Police (West), Gonda. The report revealed that the complainant’s son Lekhraj was arrested
on 30.06.2015 in a theft case of motorcycle registered vide case crime No. 641/2015 dated
29.6.2015 u/s 379 IPC PS Risiya. The complainant’s son Lekhraj Verma was picked up by
police at 11:00 pm on 27.06. 2015 from his residence as per his complaint whereas in PS
Risiya Behraich a case of motorcycle theft vide case crime No. 641/2015 dated 29.06.2015
u/s 379 IPC was registered, in connection with which accused Lekhraj Verma was said to
be arrested alongwith stolen motorcycle on 30.06.2015 at 8:00 am. There is difference of
two days between the allegations of the complainant and police version that in the case
registered on 29.06. 2015 accused Lekhraj was arrested on 30.06. 2015. During inquiry it
was prima facie found that Lekhraj Verma was illegally detained and false entry was made
in records of the PS. Hence, in this case a case should also be registered against the police
officials who are involved in it and investigated accordingly.

The Commission further observed thatthe report of SP (W) Gonda revealed that prima
facie Lekhraj Verma was detained in PS illegally and false entries made in the records of
the PS.
iv.
The Commission issued a notice u/s 18(a)(i) PHR Act, 1993 to the Government of UP through
its Chief Secretary requiring it to show cause within 6 weeks as to why the Commission
should not recommend payment of Rs.30,000/- as compensation to the victim Lekhraj
Verma.
v.
The reply is awaited.
Illegal detention of one Dharmendra Singh, (aged 30 years) by the police of PS Kotwali
Unnao, Uttar Pradesh.

The Commission received a complaint from Shri Raj Bahadur Katiyar alleging that his son
Dharmendra Singh, aged 30 years, was arrested on 4.07.2015 by the Police, PS Bangarmau,
