NATIONAL HUMAN RIGHTS COMMISSION, INDIA Chhatisgarh, 17 with the Government of Madhya Pradesh, 15 cases with the Government of Assam, 14 cases with the Government of Punjab, 13 Cases with cases with the Government of Andhra Pradesh, 6 cases each with the Government of Gujarat, Government of Tamil Nadu and Government of Telengana, 5 cases each with the Government of Arunachal Pradesh and Government of Kerala, 4 cases with the Government of Manipur, 3 cases each with the Government of Mizoram and Government of Pudduchery, Meghalaya, 2 cases each with the Government of Karnataka, Meghalaya, and UttraKhand and 1 case with the Government of Nagaland. iv. With regard to compliance reports relating to cases pertaining to previous years, compliance was awaited in 249 (155+94) cases, for details see Annexures - 6 & 7. v. Annexure-6 gives details of cases pending compliance for the year 2017-2018 in respect of payment of monetary relief. As is apparent, the State of Uttar Pradesh tops the list again as the Commission till date has not received proof of payment in 65 cases, most of which relate to civil and political rights. Other States, which had yet to forward their compliance reports in this respect were – Jharkhand and NCT of Delhi each 9 cases, Bihar 8 cases, Madhya Pradesh 7 cases, Andhra Pradesh, Rajasthan and Telangna 6 cases each, ), Assam, Chhatisgarh, Manipur, Odisha and Punjab 4 cases each, Maharashtra and West Bengal 3 cases each, Haryana and Karnataka 2 cases each, Arunachal Pradesh, Gujarat, Himachal Pradesh, Jammu & Kashmir, Kerala, ,Nagaland, Tamil Nadu and utttarkhand 1 case These cases involved allegation of mal functtioning in primary health centres and government hospitals, abduction/rape including of a scheduled caste/scheduled tribe/other backward class woman, and non-payment of pension etc.. The details of these cases have been reported in earlier Annual Reports of NHRC. The Commission once again calls upon all the aforementioned State Governments to take immediate steps for sending their compliance reports to the Commission and simultaneously take comprehensive steps for protection and promotion of civil, political, economic, social and cultural rights, along with special measures to prevent acts of violence and discrimination towards women, including those belonging to the scheduled castes, scheduled tribes and other backward classes. vi. Annexure-7 gives details of 94 cases pending compliance on the recommendations made by the Commission for the period 2009-2010 to 2017-2018 for payment of monetary relief. vii. Out of the 94 cases, where the compliance on the recommendations made by the Commission during 2009-2010 to 2017-2018, have been pending, the concerned State Governments /authorities have challenged the recommendations of the Commission in four cases by filing Writ Petitions in the respective High Courts, These are mentioned at Sl.No.7, 9, 19 and 27 of the Annexure-7 and the authorities who had challenged the recommendations are Govt. of Bihar(Sl. No.7), Indian Railway (sl. No.9 & 27) and, State of Jammu and Kashmir (Sl. No19) respectively.. Further the recommendations made by the Commission during the current year 2018-2019, in 5 cases as mentioned at Sl No. 65, 226, 246, 273 and Sl. No.441 of the Annexure 5, have been challenged by, Jawahar ANNUAL REPORT 2018-19 19
