सव भव तु सिखनः ु Upon reviewing the ma er, the Commission perceived this situa on as a poten al viola on of human rights, characterised by what seemed to be exploita on by educa onal and technical ins tu ons. The Commission took cognizance of the ma er and requested reports from the authori es concerned. The requested report from the Principal Secretary of the Department of Higher Educaon, Government of U ar Pradesh, was not received within the s pulated meframe. Subsequently, an Ac on Taken Report (ATR) was called for from the Principal Secretary of the Department of Higher Educa on, Government of U ar Pradesh. In the ATR, it was detailed that for the academic years 2019-20 and 2020-21, the ins tute had been diligent in disbursing full salaries to its employees. Moreover, it adhered to the direc ves issued by both the State Government and the University, ensuring compliance with the established guidelines. In addi on, students who had made use of the hostel facility were promptly refunded Rs. 10,000/- for the year 2019-20 and Rs. 22,500/- for the year 2020-21. The ins tu on further exhibited flexibility by allowing students to pay their fees in installments, recognising the challenging financial circumstances brought about by the pandemic. In light of the fact that the allega ons outlined in the complaint were not substan ated by the evidence provided, the Commission closed the complaint on 14 July 2022. However, the complainant was advised that they retained the liberty to pursue the ma er through appropriate legal channels, such as the court or a tribunal, should they wish to further address their concerns. with regard to pace and progress of implementaon of BLSAA-1976 and Centrally Sponsored Scheme (CSS), 2016. Such reviews have been repeated in some States considering their performance. Allega ons of Bonded Labour and Abuse in the Brick Kiln of Palwal, Haryana (Case No: 1083/7/22/2021-BL) 7.11 Rights of Bonded, Child and Other Forms of Labour 7.11.1 The Supreme Court, vide its order dated 11 November 1997 in Writ Pe on (Civil) No. 3922/ 1985 People's Union for Civil Liber es vs. State of Tamil Nadu and Others and report in 1997 (7) SCALE (SP) 17, entrusted the NHRC with the responsibility of monitoring and overseeing the implementa on of its direc ons as well as provisions of the Bonded Labour System (Abolion) Act (BLSAA), 1976, in all States/ UTs. The Commission, through its Members and Special Rapporteurs, records and assesses the performance of major bonded labour prone States/ UTs Chapter 7 - Thematic Areas The Commission received a complaint on 15 March 2021, from a widow, alleging that she and several other labourers were being held in bondage at a brick kiln owned by Kaadi, Kazal Khan, and Rashid Khan at Bharat En Udhyog, Andhrola Modamka, Hathin Kot Road, Tehsil Hathin, District Palwal, Haryana. The allega ons were grave, including non-payment of wages, caste-based harassment, physical and sexual assault, and other heinous acts. The Commission took a serious view of the human rights viola ons and directed the relevant authori es to provide reports on the ma er.
