Police Sta on Rape: Woman Assaulted by Officer in Badaun, Utar Pradesh (Case No: 19166/24/7/2020-AR) The Commission received a complaint on 01 September 2023, alleging rape by a Police Officer on 01 September 2023 within the police sta on. The complainant alleged that she had been subjected to sexual and mental abuse by him on mul ple occasions. She had reported the ma er to the police, but appropriate ac on had not been taken. In response to the direc ons of the Commission, a report dated 26 October 2020, was received from the Superintendent of Police, Shahjahanpur, U ar Pradesh. It was reported that a er an enquiry, the accused Sub-Inspector was found guilty of misusing his official posi on. Upon the complainant's complaint, an FIR was registered against him. The inves ga on was transferred to the Crime Branch, Badaun. Disciplinary proceedings had also been ini ated against the accused. In this case, a show cause no ce was issued under Sec on 18a(I) of the PHRA to the Government of U ar Pradesh, through its Chief Secretary, regarding why the CommisChapter 7 - Thematic Areas sion should not recommend payment of compensa on of Rs. 1,00,000/- (Rupees One Lakh only) to the vic m for the viola on of the Right to Dignity of the complainant by the police. A le er dated 07 July 2021, was received from the Superintendent of Police (Human Rights), U ar Pradesh, along with the report from the Superintendent of Police, Shahjahanpur, U ar Pradesh. Therefore, it would be legally appropriate to provide financial assistance to the complainant, a er the final decision was made based on the inves ga on report submi ed by CBCID. The Commission considered the report and found that no substan al evidence had been submi ed in the report to contradict the findings of the Commission regarding the viola on of the Right to Dignity of the complainant by the police. In light of the submi ed report, the Commission recommended to the Chief Secretary, Government of U ar Pradesh, to pay compensa on of Rs. 1,00,000 (Rupees One Lakh only) to the vic m whose Right to Dignity had been violated by the police.Upon issuing the show cause no ce to the Chief Secretary, Government of U ar Pradesh, a le er dated 18 October 2022, was received from the Addi onal Superintendent of Police (Rural), Nodal Officer, Human Rights Cell, Badaun, U.P. wherein it was stated that the vic m had been paid compensa on of rupees one lakh. Dowry Death of Class XII Student Found Hanging in Amroha, Utar Pradesh (Case No: 14751/24/75/2021) The Commission received an in ma on on 22 April 2021, repor ng the un mely demise of the complainant's sister, allegedly due to dowry- related issues, on 11 April 2021, in Amroha, U ar Pradesh. In response to the Commission's direc ves, requisite reports were received from the relevant authori es. The vic m had entered into matrimony with Babloo in the year 2000.
