39 Conclusion The report has discussed the situation of labor and OSH standards in sweatshop work. With the inherent vulnerability faced by workers in this industry, the findings of the survey questionnaires confirmed many existing assessments and reports that described the various issues and problems associated with sweatshop labor. Furthermore, the onset of the COVID-19 pandemic has exacerbated these existing inequalities, undermining much of the progress to improve working and living conditions—especially for workers in the informal sector. Specifically, this report found that the prevalence of precarious work, the considerable variation in the consistency of compliance with labor and OSH standards, and the widespread violation of labor and OSH standards during the ECQ period had significantly undermined the human rights of sweatshop workers. Given this situation, several policy and implementation gaps were raised based on the data analyzed and the literature review. Among the major problems raised were poor labor standards arising from conditions of widespread informality and casualization of work through contractual/"endo" arrangements, the absence of a national minimum wage, and insufficient government employment and welfare programs. Another central issue area is the widespread violation of workers' rights to safe and healthy work conditions arising from the non-implementation of OSH standards, as well as the limited capacity of the Philippine government to enforce compliance. In both cases, weak mechanisms for sanctions and monitoring for compliance in workplaces where violations occur severely undermine the ability of the government to protect labor and OSH standards, especially for sweatshop workers. In response, the report offers several policy and governance recommendations. For OSH- related concerns, there is a need to ensure that existing OSH standards are aligned with international standards. The deputization of trade union representatives should be explored to help labor inspections in the country. The passage of an LLCS Bill to improve the labor inspection system should also be considered.
