Huang Chu-wen then raised the question of procedure, demanding that Article 100 of the Criminal Code be amended by adding the words “by violence or threats” as criminal elements. Because the KMT’s Brainstorming Breakfast Assembly and the DPP had already reached a consensus on how the law would be amended, the Legislative Yuan proceeded to vote on Huang Chu-wen’s proposal. There were 56 legislators present and the proposal passed with 45 votes. At 5:50 p.m., the third reading for the amendment of Article 100 of the Criminal Code was complete. 一 However, on May 11, the DPP was shocked to find the Fourth Nuclear Power Plant motion scheduled before Article 100 of the Criminal Code on the agenda for the next day. It was clear that the KMT had played their trump card. The DPP had to make a political choice between boycotting the Fourth Nuclear Power Plant and passing amendments of Article 100 of the Criminal Code. This put the DPP in an unprecedented dilemma. On May 12, after a lengthy speech at the Legislative Yuan, the KMT—with an absolute majority—voted on unfreezing the budget for the Fourth Nuclear Power Plant, which passed with 57 votes from the 78 legislators present. Worried about affecting their cause, the DPP did not engage in physical altercations that day.
