health of prisoner, every jail or detention center should ensure:
(a)
An open enviorment
(b)
A Humane and not unduly harsh staff
(c)
Effective grievance redressal mechanism
(d)
Encouragement to receive visitors and maintain correspondence.
11. In case of all those undertrials whose trials are suspended a report should
be sent to the relevant Court on a quarterly basis.
12. On taking notice of mental unsoundness of the undertrial, the trial Court
shall follow the procedure laid down in Ch XXV.
13. In all cases where the trial of a mentally ill person is suspended for a period
longer than 50% of possible sentence, the matter should be reported to
the Hon’ble Chief Justice of the High Court for information and appropriate
action.
14. The State Government must strengthen legal aid services in case of mentally
ill persons with a view not only to providing appropriate counselling support
but also for preventing the dumping of mentally ill in prisons.
15. The State must assume responsibility for the mentally ill persons even
after discharge from the prisons.
16. There is a need to shift of focus from institutionalizing vulnerable people to
extending institutional support for caring at home, with a view to making
rehabilitation of the mentally ill and other vulnerable section more successful.
