not punishable with death or with
imprisonment for life, but in view of the
nature of the offence and circumstances
of the case the court is not in favour of
release under Sections 3 or 4, it is bound
to record its reasons for not releasing
after admonition or on probation.

Ensure that where the Court arrives at a
conclusion that an accused below 21
years does not deserve probation release,
it is mandatory to base its opinion on the
Probation Officer’s Report.

Ensure that probation release benefit can
be accorded at any stage in the criminal
trial, whether in the original hearing,
appeal or revision.

While effecting decision regarding compensation to the victims of crime,
the Court shall:

Ensure that where the Court has imposed a
sentence of fine or any other sentence
including fine, the whole or part of the fine
recovered can be applied in payment of
compensation to the victim for the loss or injury
caused by the offence.

Ensure that where the Court imposes a sentence
of which fine does not form a part, even in such
cases the accused person may be ordered to
pay compensation for the loss or injury
suffered by reasons of the act for which he is
sentenced.
