identified a threat to the right to health in the region. Based on the study, the facts identified are such as: 1. There are 8,517 tonnes of coal burning residual ash (fly ash) and bottom ash (FABA) which is a toxic and hazardous materials. Papuans utilise the remaining ash as a mixed raw material for infrastructure; 2. The smoke generated from the burning of coal gives rise to black deposits on the rainwater. The polluted rainwater used by the surrounding community for drinking and cooking resulted in their bodies itching. Komnas HAM RI provided recommendations to the Government to take action: 1. Identifying and mitigating the implications of the resource management concession permit. the Concession permits have the potential to escalate conflicts over land and damage the environment in Papua; 2. Encouraging the Government in the implementation of the energy transition program to carry out mapping and participatory by involving the Papuan people; 3. Establishing community-based renewable energy building and development schemes and respect the rights of affected indigenous peoples. 48 2. A Study on Accelerating the Recognition of the Indigenous Forests In June 2023 Komnas HAM RI conducted a study and visited the indigenous forest area of the Punan Tugung Indigenous Peoples that is threatened by the concession of P.T. Intracawood. Komnas HAM RI recommends to the Regional Government of Bulungan Regency to recognize the territory of the indigenous people of Punan Tugung through Regional Regulations and/ or Regent Decree. In addition, Komnas HAM RI also provided recommendations to the Ministry of Environment and Forestry of the Republic of Indonesia (MOE) for: a. Establishing indigenous forests and reserving indigenous forests belonging to the indigenous people of Punan Tugung through the Ministerial Decree; b. Revisiting the concession permit of P.T. Intracawood which is within the indigenous territory of the Punan Tugung Indigenous Peoples. 3.
