3. CRC application by judicial bodies

11. Although the Periodic Report states that the general principles of CRC are reflected in the
relevant legislations and rules, based on which the judicial procedures are conducted (para. 75), there
are no reported cases where CRC was referred to in making judicial decisions. It is agreed that one
of the reasons is the lack of the promotional and educational efforts to facilitate CRC
implementation by judicial bodies.

12. What is the reason that the principles and articles of CRC are not applied when the judicial
bodies making their decisions? What measures does the Government plan to take to address this
problem?

13. According to the 2009 OECD Family database, Korea ranked the lowest among the 26 Member
nations in terms of the budget for child welfare as percent of GDP: this country recorded 0.17%,
which compares with the OECD average of 2.3%.
14. Out of the overall budget for social health and welfare in 2009, child welfare took up the
smallest portion of 1%, while old people's welfare accounted for 17%; the welfare for persons with
disabilities, 3.0%; and day care and women's welfare, 9.4%.

it, as expressed in percentage of GDP, will be comparable to the OECD average?
