The right to education can only be fully enjoyed if it is accompanied by the academic
freedom of staff and students.

Members of the academic community must be free to pursue, develop and disseminate

In addition, there must be an appropriate degree of self-governance by educational
institutions. The school system must, however, be accountable to learners, parents and
communities.

freedom of choice of educational institution and educational programme.

Children (subject to their age and maturity), their parents and legal guardians have the
right to choose education which accords with their own beliefs and convictions.

This choice is subject to the obligation to promote the best interests of the child.
•
States must respect the freedom of individuals to provide religious or linguistic
instruction in schools established by members of that religion or culture.
•
Parents, legal guardians and children (subject to their age and ability) should be able to
choose between specialised or mainstream schools for children with disabilities or special
learning needs.

the nature and scope of the obligation of States to receive and to provide
international assistance and cooperation.

States have an obligation to seek international assistance and co-operation, especially
economic and technical, if their resources are not sufficient to fulfil their obligations in
relation to the right to education.
•
The international community has an obligation to assist and co-operate in the realisation
of the right to education and must commit funds and expertise in this regard.
•
Economic assistance and co-operation should include providing funds and debt relief.
•
The provision of technical assistance and co-operation requires States to exchange
information, experiences and innovations. In addition, States should provide assistance in
