TERMS OF REFERENCE The Institute for Popular Democracy and the Commission on Human Rights have conducted this review in accordance with the following terms of reference. The review has analysed the Philippines’ compliance with international human rights law in relation to evictions and resettlement within Metropolitan Manila. 1. Terms of Reference (a) Determine the standards established by international law that are applicable to the Government of the Philippines during evictions and resettlement, to be used as indicators of human rights enforcement, with particular reference to: i. The formation of these standards through international treaties, conventions and secondary interpretive instruments; ii. The distinction between housing rights generally and the special protections required during evictions and resettlement; iii. The special interests of vulnerable groups during evictions and resettlement; iv. Legal or other measures necessary for the realisation or enforcement of these standards; and v. The participation and involvement of individuals and groups affected by government eviction and resettlement programmes. (b) Determine the institutional and legal framework that governs eviction and resettlement in the National Capital Region. (c) Determine the performance of responsible government agencies and institutions in implementing and enforcing this legal framework. (d) Determine whether and to what extent government performance and the institutional framework itself fall short of the standards established by international law. (e) Determine and recommend the adoption of additional legal and policy measures to promote greater compliance with the standards established by international law. xiv
