16. The Terms of Reference 4 of the Public Inquiry (“Terms of Reference”) are as follows: (a) To determine whether these are cases of enforced disappearances as defined under the Interna�onal Conven�on for the Protec�on of All Persons from Enforced Disappearances or are cases of involuntary disappearances in breach or breaches of the criminal and/or civil law and/or applicable human rights laws (hereina�er referred to as such alleged breach or breaches); (b) If (a) has been established at the inquiry: (i) (ii) (iii) How such alleged breach or breaches came about; To iden�fy person(s) or agency(ies) responsible for such alleged breach or breaches; What administra�ve direc�ves or procedures, or arrangements contributed to such alleged breach or breaches. (c) To consider whether the authori�es, specifically the Royal Malaysian Police have taken adequate steps to inves�gate such alleged breach or breaches. (d) To recommend measures or guidelines to be taken to ensure that such alleged breach or breaches do not recur. Public Inquiry into the Disappearance of Amri Che Mat 17.
