The Panel recommends that the Government of Malaysia should review the Penal Code and the Criminal Procedure Code to incorporate enforced or involuntary disappearances under a category specific to cases involving missing persons. In other words, amendments shall effec�vely make it an offence under the Penal Code, in addi�on and separate from the offence of abduc�on and kidnapping. Ratifying International Instruments 194. Malaysia has not ra�fied the Interna�onal Conven�on for the Protec�on of All Persons from Enforced Disappearance 2006. 194.1. 64 65 66 67 68 By ra�fying the Conven�on, Malaysia will assume an interna�onal obliga�on to eradicate enforced disappearance. The measures set out in the Conven�on include provisions on, among others (f) the effec�veness of inves�ga�ons into enforced disappearances and involuntary disappearances64 ; (g) bringing those directly and indirectly involved to account for their ac�ons65 ; (h) the crea�on of an addi�onal offence in the penal law with enhanced sentencing for enforced disappearances66 ; (i) the provision of informa�on to the families of vic�ms67 ; and (j) the training of law enforcement officers 68.
