In its role to make recommendations and monitor human rights advancement, Komnas HAM
RI has initiated several things related to the mitigation of COVID-19. First, conducted research
entitled Tata Kelola Penanggulangan COVID-19 dalam Perspektif HAM (Countermeasures
Management Against COVID-19 in a Human Rights Perspective). This research contains
Komnas HAM RI’s analysis on the implementation of policies or programs conducted by
the government as part of the efforts to mitigate COVID-19. Second, prepared a Position
Paper and Recommendations on Human Rights Perspectives Policy which was submitted to
President Joko Widodo on 30 March 2020.16
Understanding and emphasizing the role of National Human Rights Institutions (NHRIs)
such as Komnas HAM RI, is essential in an uncertain situation such as the ongoing COVID-19
pandemic. Komnas HAM RI’s mandate is clearly stipulated in the Human Rights Law and
includes the authority to monitor the human rights situation in the country, and advising
the government on how to align policy, programming, and administrative practice with
international human rights standards.17 Against such background, this research aims to
figure out Komnas HAM RI’s role in the context of the COVID-19 pandemic, by looking at
how its observations and recommendations bear relevant for Indonesia’s work with the
Sustainable Development Goals, considering that the pandemic also had impacts on the
progress in achieving the goals.
By contextualizing Komnas HAM RI’s work in the spectrum of the SDGs, this research is
expected to elaborate its role from a broader and multi-dimensional approach. Practically,
this research looks at the SDGs, and their embedded human rights values, norms, and
principles, and aims to give assistance to Komnas HAM RI in identifying areas in which the
SDGs can serve as a framework for its dialogue with the government. Moreover, so far,
there has been no research in the Indonesian context that has tried to see the COVID-19
pandemic in the framework of human rights and SDGs at once. This research was undertaken
to fill the gap.
1.1. Research Questions
1. How to understand the role and function of Komnas HAM RI amid the COVID-19
pandemic, through the SDGs framework?
2. What SDGs and targetsintersect with Komnas HAM’s oberservations on the human
rights implications of the COVID-19 pandemic? And how can Komnas HAM RI’s
mandate and authority serve to support the government in responding to and
mitigating the impacts of the COVID-19 crisis?
