Komnas HAM considers that the process of establishing government regulations has been very slow and delayed. Of the 8 Draft Government Regulations, only two have been completed and passed. The deliberation of Draft Government Regulation on Concessions and Incentives was rejected by the Ministry of Finance although it was stipulated in Presidential Regulation No. 33 of 2018 on National Action Plan on Human Rights. The Committee stated that the delayed process of establishing a draft government regulation and the rejection of one of the draft government regulations was a disregard of the mandate of the disability law. List of Issues 1. What measures have been taken by the government to harmonize the discriminatory legislations, such as the Law on Civil Service? 2. Regarding the physical and mental health requirement, how can the Indonesian Government see to it that recruitment processes will not discriminate against persons with disabilities in all and ensure inclusive participation in public offices, civil service, and fulfilment of other civil rights? 3. With regard to the delayed deliberation of some of the draft government regulations, how can the government ensure expedient formulation and implementation of such regulations and ensures the inclusive public participation of persons with disabilities? 4. The government still perceives disability as an issue under the responsibility of the Ministry of Social Affairs, turning it into another part of the social problems. How can the government ensure and involve all ministries to take responsibility in the fulfilment of rights for persons with disabilities? 3
