Komnas HAM, Indonesia UNCRPD Written Contribution Komnas HAM and the Ombudsman oversaw a case of prospective student with mental and/or psychosocial disability who got rejected in a state university registration for being categorized as physically and mentally unhealthy.29 44. The said cases of rejection and requirements imposed by educational institutions occurred as a result of the lack of institutions authorized to identify the types and degrees of disabilities and their relevance to different teaching and learning requirements. There is a need for an objective, non-discriminatory supervisory institution that determines the requirements of prospective students for persons with disabilities. List of Issues 1. What measures will the government take to eliminate the physical and mental health requirement from school enrolment at all levels and all areas of education? 2. How can the government ensure that there will be no more rejection of students with disabilities in all educational institutions from primary to higher education level? 3. How can the Government increase the capacity, quality, and number of assistant teachers for students with disabilities as supporting elements in inclusive schools, as well as the adequate facilities and infrastructure? 4. How can the government ensure the availability of technical guidelines for the implementation of appropriate accommodation for students with disabilities? Article 25 Health 45. Responding to Paragraphs 149 through 159 of the Government Report, Komnas HAM believes that there is a fundamental misunderstanding about Health and Social Security, in which the current health services are provided based on insurance scheme rather than social security. The health insurance does not accommodate some of the needs of persons with disabilities and their assistive tools.
