Annual Report 2016 Judgment of Appellate Division in regards to Section 54 and 167 of the Code of Criminal Procedure On 24 May, 2016 Appellate Division of the Supreme Court upheld the decision of HCD on Section 54 and 167 of the CRPC regarding arrest without warrant and interrogation during remand and issued directions on the said sections. 12 NHRC has been raising its voice regarding the abuse of section 54 and 167 of CRPC from time to time. NHRC is on the opinion that direction of the higher court should be followed duly which will ultimately promote human rights of the people and bring a conducive change in the criminal justice delivery system. Trial of Crime against Humanity In addition to the execution of the other war criminals, the leader of terrible Al-Badr forces Mir Quasem Ali was executed on 11 May, 2016 following due process of law. Trial of some other accused is also under process. NHRC has been vocal for the trial of those who committed war crime against humanity during liberation war back in 1971. NHRC believes that these ongoing trials are the examples in addressing the culture of impunity in our country. Eviction and Displacement: Right to Shelter Under the ownership of Housing and Building Research Institute there are about 50 acres of land out of which a slum was developed on 15 acres at Kalyanpur, Dhaka. Almost twenty thousands of people used to 11 live over there. On January 01, 2016 in the morning, the authority went for eviction. There was a clash between slum dwellers and the police. At least 15 people were injured. Authority started eviction without giving sufficient time and arrangement of rehabilitation. HCD issued stay order over the eviction for 3 months and the process of eviction was stopped. At the same time police was directed not to arrest and harass the slum dwellers. On January 02, there was an incident of arson due to which 70 houses were gutted. The slum dwellers alleged that their houses were torched with an ill motive. Government has to take appropriate measure against such activities. 13 NHRC considers that eviction should be made with due process of law. Moreover, notice should be given with sufficient time to the victims and their rehabilitation arrangement should be ensured first. The right to health Government has taken lots of initiatives in establishing hospitals including satellite clinic in every union, recruitment of new doctors, nurses and other paramedics.
