REPORT BY THE SUB-COMMITTEE ON UNCRC United Nations Convention on the Rights of the Child(UNCRC) Article 2 109(Non Discrimination, Protection Against Punishment) States Parties shall ensure Rights set forth in the CRC- irrespective of the child’s or parent’s or legal guardian’s • race, • colour, • sex, • language • religion • political opinion • national/ethnic or social origin • property • disability • birth • or other status States Parties shall take all measures to ensure: • child is protected against discrimination or punishment on the basis ofthe above. 39 Provisions in the Constitution of India and Domestic Legislation/Policy Measures in Consonance with UNCRC Constitution of India 1) Article 14 110 : Right to Equality 2) Article 15 111: Prohibition of discrimination on the grounds of - religion, race, caste, sex, Place of birth and by implication 3) Article 15 covers colour also. 4) Article 17 112 : Practice of untouchability has been abolished. 5) Article 18 113 has abolished all titles conferring status. 6) Article 21 114No person to be deprived of his life or personal liberty except according to procedure established by law. 7) Article 25 115: Freedom of conscience and free profession, practice and propagation of religion. 8) Article 29(1) 116 states No citizen shall be denied admission into any educational institution maintained by the State or receiving aid out of State funds, on grounds only of religion, race, caste, language or any of them. 9) Article 30 117: Rights of Minorities Gaps between UNCRC & Indian Laws (G) and Recommendations(R) G26: There is no enabling legislation to prohibit discrimination in private and unorganised sector on ground of religion, sex, ethnicity and language.
