to take remedial measures. Equity, on the other hand, is not usually reinforced by law. Guideline 12: A decent home must be accessible to everyone without discrimination on prohibited grounds, such as disability, ethnicity, religion, age, gender or sexual orientation. Effective measures, designed to address the unfair disadvantage experienced by some individuals and communities, are required. E. Participation 56. All individuals and communities are entitled to active and informed participation on issues relating to their housing, including policy making and accountability. Te Tiriti requires government to work in partnership, and share decision-making, with its Tiriti partners. The United Nations Declaration on the Rights of Indigenous Peoples highlights the right to free, prior and informed consent in relation to initiatives, including housing-related initiatives, that affect indigenous peoples. The Convention on the Rights of Persons with Disabilities includes an obligation to actively involve disabled people in all issues, including housing, that affect them. Under the Convention on the Rights of the Child, all children may participate in decisions that affect them, in accordance with their age and maturity. Guideline 13: In accordance with international human rights treaties and declarations, ensure all individuals and communities have the opportunity for active and informed participation on housing issues that affect them. Additionally, Te Tiriti requires government to work in partnership, and share decision-making, with its Tiriti partners. F. A Tiriti and human rights-based housing strategy 57. Realisation of the right to a decent home grounded on Te Tiriti does not happen spontaneously, it requires an overarching housing strategy. 58. A housing strategy operates at a higher level than a housing policy or programme. It has a vision of change over time and engages numerous bodies, including a range of government departments at different levels. It coordinates a wide range of laws, policies, programmes and initiatives that, when taken together, create a housing system. 20
