(b) for a body corporate, to a fine not exceeding 500
penalty units.
59. Offence of failure to attend or provide documents –
A person commits an offence who, after having been
summoned, fails, without reasonable excuse, to appear or to
produce any documents, books or information in the person’s
custody or control, before the Ombudsman, and is liable on
conviction:
(a) for an individual, to a fine not exceeding 200 penalty
units or to imprisonment for a term not
exceeding 6 months; and
(b) for a body corporate, to a fine not exceeding 500
penalty units.
60. Offence of refusal to give evidence – A person appearing
as a witness before the Ombudsman commits an offence who
refuses to be sworn or to make an affirmation or to answer a
question relevant to the inquiry put to the witness, and is liable
on conviction:
(a) for an individual, to a fine not exceeding 100 penalty
units or to imprisonment for a term not
exceeding three (3) months; and
(b) for a body corporate, to a fine not exceeding 500
penalty units.
61. Perjury – A witness before the Ombudsman who
knowingly gives evidence that is false commits the offence of
perjury under the Crimes Act 2013.
62. Contempt – A person commits an offence who wilfully
insults the Ombudsman, or wilfully interrupts the proceedings
of the Ombudsman, or is in any manner guilty of wilful
contempt of the Ombudsman, and is liable on conviction:
(a) for an individual, to a fine not exceeding 200 penalty
units or to imprisonment for a term not
exceeding 6 months; and
(b) for a body corporate, to a fine not exceeding 500
penalty units.
