รัฐภาคีแหํงกติกานี้รับที่จะประกันสิทธิอันเทําเทียมกันของบุรุษและสตรี ในการที่จะอุปโภคสิทธิ
พลเมืองและสิทธิทางการเมืองทั้งปวงที่ได๎ระบุไว๎ในกติกานี้
Article 3
The States Parties to the present Covenant undertake to ensure the equal right of
men and women to the enjoyment of all civil and political rights set forth in the present
Covenant.
ข้อ 14
ข๎อ 1. ยํอย บุคคลทั้งปวงยํอมเสมอกันในการพิจารณาของศาลและคณะตุลาการ ในการพิจารณา
คดีอาญาซึ่งตนต๎องหาวํากระทาผิด หรือการพิจารณาคดีเกี่ยวกับสิทธิและหน๎าที่ของตน บุคคลทุกคนยํอมมี
สิทธิได๎รับการพิจารณาอยํางเปิดเผยและเป็นธรรม โดยคณะตุลาการซึ่งจัดตั้งขึ้นตามกฎหมาย มีอานาจ มี
ความเป็นอิสระ และเป็นกลาง สื่อมวลชนและสาธารณชนอาจถูกห๎ามเข๎าฟังการพิจารณาคดีทั้งหมดหรือ
บางสํวนก็ด๎วยเหตุผลทางศีลธรรม ความสงบเรียบร๎อยของประชาชน หรือความมั่นคงของชาติในสังคม
ประชาธิปไตยหรือเพื่อความจาเป็นเกี่ยวกับสํวนได๎เสียในเรื่องชีวิตสํวนตัวของคูํกรณี หรือในสภาพการณ์
พิเศษซึ่งศาลเห็นวําจาเป็นอยํางยิ่ง เมื่อการพิจารณาโดยเปิดเผยนั้นอาจเป็นการเสื่อมเสียตํอประโยชน์แหํง
ความยุติธรรม แตํคาพิพากษาในคดีอาญา หรือคาพิพากษาหรือคาวินิจฉัยข๎อพิพาทในคดีอื่นต๎องเปิดเผย
เว๎นแตํจาเป็นเพื่อประโยชน์ของเด็กและเยาวชน หรือเป็นกระบวนพิจารณาเกี่ยวด๎วยข๎อพิพาทของคูํสมรส
ในเรื่องการเป็นผู๎ปกครองเด็ก
Article 14
1. All persons shall be equal before the courts and tribunals. In the determination
of any criminal charge against him, or of his rights and obligations in a suit at law,
everyone shall be entitled to a fair and public hearing by a competent, independent and
impartial tribunal established by law. The press and the public may be excluded from all
or part of a trial for reasons of morals, public order (order public) or national security in a
democratic society, or when the interest of the private lives of the parties so requires, or
to the extent strictly necessary in the opinion of the court in special circumstances where
publicity would prejudice the interests of justice; but any judgment rendered in a criminal
case or in a suit at law shall be made public except where the interest of juvenile
persons otherwise requires or the proceedings concern matrimonial disputes or the
guardianship of children.

บุคคลทั้งปวงยํ อมเสมอกันตามกฎหมาย และมีสิ ทธิที่จะได๎รับความคุ๎มครองเทําเทียมกันตาม
กฎหมาย โดยปราศจากการเลือกปฏิบัติใดๆ ในกรณีนี้ กฎหมายจะต๎องห๎ามการเลือกปฏิบัติใดๆ และต๎อง
ประกันการคุ๎มครองบุคคลทุกคนอยํางเสมอภาคและเป็นผลจริงจังจากการเลือ กปฏิบัติด๎วยเหตุผลใด เชํน
