disabilities to medical institutions and facilities, and information on the community-based
rehabilitation treatment structure, which allows persons with disability to receive
rehabilitation treatment in their resident community.
74. Provide information of the government policies to alleviate financial burden caused by
additional medical expenses for disability treatment, and to protect the right to health of
persons with disabilities.
75. Specify whether a structure of systematic risk evaluation based on objective statistical
data, such as the mortality rate and the incidence of disease and disaster, is being utilized by
the insurance companies to provide insurance subscription services for persons with
disabilities; and provide the government’s plans to retract its reservation to Article 25,
paragraph (e) of the Convention.
Article 27- Work and Employment
Current status
76. According to the statistics of the Ministry of Employment and Labor, 1,514 cases (58
percent), out of 2,609 cases applied at the end of 2016, were permitted to be excluded from
the minimum wage standards on the ground of the disability clause of the Minimum Wage
Act (MWA). Furthermore, 7,935 workers from 656 enterprises were being excluded from the
minimum wage standards. At the present moment, there is no other means or policy
complementary to the exclusion from application of minimum wage clause (Article 7), and
the government is of the opinion that closing down shelter workshops, which seem to be the
only alternative place to conduct work and social activities for persons with severe
disabilities, is not an appropriate practical option.
77. Based on the Employment Promotion and Vocational Rehabilitation of Disabled Persons
Act (EVDPA), the 2016 standard requires the central and local governments, public agencies and
private businesses to hire disabled workers to make up at least 3.0 percent, 3.0 percent and 2.7
percent, respectively, of workforce. However, the Ministry of Employment and Labor’s data
indicates that the rates of mandatory employment of disabled workers fell short from the EVDPA
standard, and the rates were only reaching 2.81 percent, 2.96 percent and 2.56 percent,
