Provide detailed information on measures the government has taken to prevent violence and abuse against persons with mental disabilities, who are under medical treatment, convalescence or rehabilitation in mental health care facilities. 50. Specify measures taken by the government to implement the Commission’s recommendation made to the Minister of Health and Welfare, on 4 August 2016, to establish a standard process for the use of confinement and restraint and further incorporate it into legislation in order to minimized human rights violation occurrence caused by unreasonable confinement and restraint in psychiatric medical institutions. 51. Considering that the majority of psychiatric medical institutions are private facility (90 percent), and are reluctant to open facilities for monitoring, specify whether effective monitoring could be carried out by the “human rights protection task force”, and the operation plan of the task force including its organizational structure, human resources, budget and etc. Article 16- Freedom from Exploitation, Violence and Abuse Current status 52. The WDPA amendment in 2015 has set legal ground for the establishment of a central and 17 regional institutions for the protection of rights and interests of persons with disabilities. By 20 November 2017, the National Advocacy Agency for Persons with Disabilities (NAAPD) and 7 Regional Advocacy Agency for Persons with Disabilities (RAAPD) were established to receive reports on abuse of persons with disabilities, carry out on-site investigation, and provide emergency protection, counseling and follow-up management for victimized persons with disabilities and their families. 53. As the Act on Guarantee of Rights of and Support for Persons with Developmental Disabilities (AGRSPDD) came into effect in 2015, the NAAPD and 17 RAAPDs were established, and are currently receiving reports on abuse including abandonment, carrying out on-site investigation, and providing protection to protect the rights of persons with developmental disabilities. 15
