The guideline was of great assistance on holding a peaceful and a fair election and for the protection of Fundamental Rights guaranteed by the Constitution and by International Human Rights norms. It was specially noted that omissions on the part of the Police on violence committed before, on or after the day of election, violates rights guaranteed for equal protection before law under Article 12 of the Constitution. In addition, the impartiality in inquiring into complaints, restraining to take any action for complaints due to political pressure also violates provisions of Article 12. This guideline was also issued to public officers and security personnel (Please refer to Annex 04 for the Guidelines to be followed at the Provincial Council Elections). In addition, paper notices were published in Sinhala, Tamil and English languages highlighting the fact that voting is a human right. The officers of the Commission took measures to monitor whether the election held on 21.09.2013 was a free and a fair one. 37
