4 What does the law say? (ii) Discrimination against club members It is also unlawful for a club to discriminate against a club member based on their sex or gender identity: • in the terms or conditions of membership that are afforded to the member • by refusing or failing to accept the member’s application for a particular class or type of membership • by denying the member access, or limiting the member’s access, to any benefit provided by the club • by depriving the member of membership or varying the terms of membership, or • by subjecting the member to any other detriment.29 (d) Unlawful requests for information It is unlawful to request or require a person to provide information if: • the information is requested in connection with, or for the purpose of doing an act, and • it would be unlawful (in particular circumstances) in doing that act to discriminate against a person based on their gender identity or sex, and • people who are of a different sex or gender identity would not be asked to provide the same information.30 20
