Article 5, Paragraph 1 63 of the Labor Inspection Act stipulates that the authority to conduct inspections lies with labor inspection agencies established or authorized by the MOL, municipal authorities, or other relevant agencies. In principle, the central government is responsible for safety and health inspections, while local governments oversee inspections of labor conditions. However, the central government may delegate authority. The division of labor is outlined as follows: (1) Central implementation of safety and health inspections The MOL previously established OSHA, which is responsible for planning labor inspection policies, drafting regulations, and supervising the activities of labor inspection agencies. Three regional occupational safety and health centers (Northern, Central, and Southern) under OSHA handle frontline labor inspection tasks. Additionally, OSHA has authorized labor inspection agencies established by the Ministry of Economic Affairs' Bureau of Industrial Parks (formerly the Export Processing Zone Administration), the National Science and Technology Council’s Hsinchu Science Park Bureau, and labor inspection agencies in six special municipalities. These agencies oversee the enforcement of the Occupational Safety and Health Act and its associated regulations within their jurisdictions. Currently, labor inspections in the fisheries sector have not been delegated to any labor inspection agency established under the Fisheries Agency. 63 Article 5 of the Labor Inspection Act: “Labor inspection shall be enforced by the labor inspection agency which is established by the Central Competent Authority or by the delegation of inspection power from the Central Competent Authority to the municipal competent authority. When necessary, the labor inspection agency may conduct joint inspection with the county/city competent authority. The power of labor inspection as prescribed above shall be delegated according to the requirements in the Act and under the direction and supervision of the Central Competent Authority. The criteria of the organization and staff for the labor inspection agency shall be developed by the Central Competent Authority according to the number of business entities which shall be inspected and the characteristics of each inspection region, and shall be approved by the Executive Yuan.” 68
