4.238 The Commission had observed that the Railway Department had violated the human rights of the complainant, now deceased, by delaying payment of his dues and thus issued notice to show-cause as to why it should not recommend compensation to the next of kin of the deceased for violation of his human rights. It also directed to initiate departmental inquiry against all those officials responsible for delay in release of legitimate dues to the complainant. Moreover, the NHRC called for a report whether any interest has been paid to the widow of the deceased on delayed payments and the amount thereof. The report is awaited by the Commission. D. Commission’s Recommendations on Grant of Monetary Relief to Victims of Human Rights Violations/Next of Kin of the Deceased/ Disciplinary Action/ Prosecution Against Errant Public Servants 4.239 During 2008-2009, the NHRC recommended monetary relief amounting to Rs.5,02,49,000 to the victims/next of kin of the deceased in 373 cases. Out of these 373 cases, it also recommended disciplinary action against the delinquent police officials/public servants in 11 cases and prosecution of the errant police officials in one case. The State-wise details of these cases are given in Annexure-6. 4.240 The NHRC received compliance reports in 111 cases out of 373 cases relating to monetary relief and a total amount of Rs. 1,02,90,000 was paid to the victims/next of kin of the deceased. It also received compliance report in 1 case, in response to its recommendations for disciplinary action against the delinquent public servant. It is yet to receive compliance reports in 262 cases where monetary relief amounting to Rs. 3,99,59,000 was recommended by the Commission (Annexure-7). It is also awaiting compliance reports in 10 cases relating to recommendation for disciplinary action against the delinquent police officials (Annexure-8) and in one case pertaining to recommendation for prosecution of the errant police officials (Annexure-9). 4.241 As regards compliance reports relating to previous years, the NHRC has not received compliance reports in 71 cases for the period from 1999-2000 to 2007-2008 (Annexure-10).
