He was also directed to apprise the Commission of the action taken by the State Government on the recommendations of the High Level Committee. 4.218 Thereafter, the Additional Director General of Police (HQs.), Orissa, submitted a report dated 16 July 2008 stating that three persons had died and 34 persons were injured during the riots and that a financial assistance of Rs. 1, 00,000 each had been given to the next of kin of the deceased persons. Action taken report in respect of the recommendations made by the High Level Committee was also submitted by the Additional Director General of Police. The said report was considered by the NHRC on 21 November 2008 whereby it observed that the report was silent about any compensation paid to 34 injured persons. It also observed that the progress of implementation of the recommendations made by the High Level Committee was very slow. It further noted that the Central Government was yet to take a decision on the proposal of inclusion of Kandhamal under the Security Related Expenditure (SRE) scheme. 4.219 The Commission on 21 November 2008 thus directed the Director General of Police, Orissa, to furnish a complete report giving details of all the deaths as well as those injured along with proof of ex-gratia payment made to the affected persons. He was also directed — (a) to ensure that investigation of all the violence related criminal cases was expeditiously concluded, and (b) to take steps for filling up of all the vacant posts in the police force etc. and submit an action taken report thereof. In addition, the Commission recommended to the Central Government to take a quick decision on the proposal of the State Government for inclusion of Kandhamal under the SRE scheme. 4.220 The case is under consideration of the Commission. 22. Suo motu Cognizance of Programme “Operation Kalank” on ‘Aaj Tak’ on Post- Godhra Violence (Case No.426/6/18/2007-2008) 4.221 Pursuant to the directions given by the NHRC, the Central Bureau of Investigation (CBI) submitted its report to the Commission. It concluded that the recordings in the ‘Sting Operation’ were found to be authentic as per Forensic Science Laboratory Report and most of the concerned persons appearing in the sting operation had admitted that they were contacted and had spoken on the subject. 4.222 Meanwhile, the Chairman, Special Investigation Team, which was constituted by the Supreme Court, requested that all the material collected by the CBI in connection with the sting operation be sent to him. The CBI informed that the two spy cameras and the recorder used in the sting operation had been returned to Tehelka. However, 16 DVDs of sting operation and five CDs of ‘Operation Kalank’ were handed over to the Special Investigation Team. 4.223 The NHRC, while observing that the matter was being investigated by the Special Investigation Team under the directions of the Supreme Court, and the concerned DVDs and CDs had already been handed over by the CBI to the Special Investigation Team, closed the 64
