Killing of Innocent Persons by Meghalaya Police (Case No. 11/15/2005-2006) 4.176 The NHRC has received the requisite reports from the Director General of Police, Meghalaya in respect of allegations of killing of five suspected National Socialist Council of Nagaland – Isak-Muivah (NSCN-IM) cadres by a Special Operation Team of Meghalaya Police at Mawlyngade, Sohryngkhan, East Khasi Hills District. The matter is still under consideration of the Commission. 6. Death of Two Employees of Delhi Jal Board while Working in a Sewer (Case No. 716/30/2005-2006) 4.177 In response to the show-cause notice issued by the NHRC to Delhi Jal Board, it was informed by the Jal Board that Rs. 3, 56,980 and Rs. 3, 11,755 had already been paid to the next of kin of the deceased Junior Engineer and Beldar respectively. Besides, compassionate appointments had also been given to the wives of the deceased. The case has since been closed by the NHRC. 7. Prolonged Detention of Undertrial Prisoner Jag Jeevan Ram in Uttar Pradesh (Case No. 35741/24/2005-2006) 4.178 The NHRC had called upon the Chief Secretary, Government of Uttar Pradesh to apprise it as to how long the victim remained in the hospital after being declared fit and sent to the jail on 21 September 2005. Despite a reminder to the Chief Secretary, Government of Uttar Pradesh, the report is still awaited by the NHRC. 8. Detention of Undertrial Prisoner Shankar Dayal for 44 years in Unnao Jail, Uttar Pradesh (Case No. 37484/24/2005-2006) 4.179 The NHRC was informed that one Shankar Dayal, an undertrial prisoner who was mentally sick was declared fit on 25 November 2005 and released on 18 February 2006, as per the orders of the Chief Judicial Magistrate. The Commission as such directed the Director General Health Services (DGHS), Government of Uttar Pradesh to examine whether there had been some lapse on the part of the Mental Hospital, Varanasi, in treating the victim. 4.180 In response, a report was received from the Director General of Health Services, Government of Uttar Pradesh, which revealed that Shankar Dayal was given treatment at the Psychiatric Hospital in Varanasi as per the report of the Medical Board. He was produced before the Visitors Board on 19 April 2005 but was not declared mentally fit. Thereafter, he was again produced before the Visitors Board on 25 November 2005, and was declared medically and mentally fit. Consequently, recommendations were made to transfer him to the jail concerned. The allegations of negligence in the matter were denied in the report. The Commission on consideration of the report closed the case. 57
