Annual Report 2008-2009 4.171 The case relates to settlement and hushing up of a rape and murder incident by a caste panchayat in Baghpat, Uttar Pradesh. The Superintendent of Police, Baghpat informed that criminal cases were registered against the culprits with regard to the incident of rape and murder. Since the allegation of murder and rape was not substantiated, the NHRC directed the State Government of Uttar Pradesh to apprise it about the steps taken by them to prevent the interference of caste panchayats in the criminal justice delivery system. The case was closed by the NHRC with appropriate directions to the State Government. 2. Alleged Abduction and Killing of Jalil Andrabi, Advocate, Jammu & Kashmir (Case No- 9/123/1995-LD) 4.172 The matter relates to alleged abduction and subsequent killing of Jalil Andrabi, an Advocate in Srinagar by the Security Forces. Pursuant to the Commission’s direction, the report received revealed that a case FIR No. 139/1996 under section 302/365/364/201 Ranbir Penal Code, was registered against the accused Major Avtar Singh, who had been absconding. The NHRC had directed the Ministry of Defence, Government of India and the Secretary to the Chief of the Army Staff to ensure that Major Avtar Singh appears in the court of Chief Judicial Magistrate, Budgam for undergoing trial in the case. In response, the Ministry of Defence communicated that the court of enquiry has declared TA-42277 Major Avtar Singh a deserter, and as such the Army was not in a position to produce the officer in the court. The NHRC, on consideration of the report received from the Ministry of Defence, has closed the case. 3. Kidnapping of Minor Girls from Outside the BSF Camp in Kishanganj District, Bihar (Case No. 2610/4/2005-2006-WC) 4.173 In this case, the NHRC on 18 May 2007 had directed the Chief Secretary of Bihar to get the complaint concerning alleged kidnapping of two daughters of the complainant enquired through CB-CID. The report of CB-CID is still awaited in the matter. 4. Illegal Detention and Torture of a Minor by Haryana Police (Case No. 1453/7/2005-2006) 4.174 The case relates to torture of a 12 year old boy Mukesh by Haryana police. It was reported that the accused policeman was arrested and a charge sheet had been filed against him. The policeman, however, was released on bail by the court. The State authorities further reported that the Supreme Court was also seized of the matter and that further action would be taken as per the orders of the Apex Court. 4.175 However, it was observed by the Commission that the name of the victim had been mentioned in the State authorities report as Sumit Kumar whereas in the news report, in question, the name was mentioned as Mukesh. The NHRC, therefore, directed the Director General of Police, Haryana to clarify the discrepancy with regard to the name of the victim. He was also directed to inform the NHRC about the order passed by the Supreme Court in the matter. The response of the State Government is awaited. 56
