Annual Report 2008-2009 4.133 After perusal of the report submitted by the team of Investigation Division, the Commission ordered that a copy of the report be sent to the Secretary, Health, Government of NCT of Delhi for comments and appropriate action. The response from the Government of NCT of Delhi is awaited and the matter is under consideration of the NHRC. 30. Inhuman Treatment of Patients in a Home for Mentally Challenged at Delhi (Case No. 450/30/2005-2006) 4.134 A complaint was received from one Shri Mohan Snehi, President, Society for Environmental Protection and Human Rights, referring to a news channel report about Asha Kiran, a Home run by Delhi Administration for mentally challenged children and adults in NCT of Delhi. It was alleged that the mentally challenged children of the said Home were forced to carry out different kinds of activities such as sweeping, mopping, cooking and other odd jobs. Besides, inhuman, unhygienic and pathetic conditions prevailed in the Home. These children as well as other patients were not provided nutritious food nor sufficient clothing or other items of daily usage like beds, bed sheets, blankets, etc., and were also beaten. 4.135 Pursuant to the directions given by the Commission on 21 August 2006, a team from the Investigation Division of NHRC visited the Home and submitted its report. The facts stated by the NHRC’s investigation team was considered by the Commission and forwarded to the Department of Social Welfare, NCT of Delhi for appropriate action. The Department of Social Welfare, Government of NCT of Delhi subsequently submitted a compliance report and the Commission vide its proceedings dated 27 October 2008 directed the NHRC team to re-visit Asha Kiran Home to ascertain on the spot progress. 4.136 The team visited Asha Kiran Home for the second time on 3 and 4 December 2008. It found no progress with regard to reduction in over-crowding of the patients, increase in the number of staff, improvement in the hygienic conditions related to toilets and bathrooms, improvement in the quality of cooked food, lodging of patients as per their IQ in male wards, segregation of patients having infectious diseases, provision of winter clothings for patients and improvement in the nutrition level of food served to the patients. The team from the Investigation Division also noticed patients working in the kitchen, ironing clothes and doing other odd jobs. Due to the absence of a Special Educator in the Home, no improvement was found in its co-curricular activities. 4.137 On the basis of the report submitted by the officers of the Investigation Team, summons were issued by the Commission to the Secretary, Social Welfare Department, Government of NCT of Delhi to appear before it on 6 April 2009 so that the problems and other issues of the Home could be discussed. The matter is thus under consideration of the Commission. 31. Surgical Scissors Left in the Abdomen of a Woman during Operation due to Negligence of Doctors (Case No.202/18/3/2007-2008) 50
