SECTION I. FUNDAMENTALS OF THE CONSTITUTIONAL SYSTEM OF
TURKMENISTAN
Article 1. Turkmenistan shall be a democratic, law-governed and secular State which form of
government shall be a presidential republic.
Turkmenistan shall have the supreme and full power on its territory, and independently
pursue its domestic and foreign policies. The state sovereignty and territory of Turkmenistan
shall be unified and indivisible.
The State shall protect the independence, sovereignty, territorial integrity and constitutional
system of Turkmenistan, and ensure law and order.
Article 2. Turkmenistan shall have the status of permanent neutrality, recognized by the
international community and secured by law.
The United Nations, in the Resolutions of the General Assembly “Permanent Neutrality of
Turkmenistan” of 12 December 1995, as well as of 3 June 2015 has recognized and supported
the status of permanent neutrality proclaimed by Turkmenistan, and called upon the Member
States of the United Nations to respect and maintain this status of Turkmenistan, also
respecting its independence, sovereignty and territorial integrity.
Turkmenistan’s permanent neutrality shall be the basis of its domestic and foreign policy.
Article 3. The people shall exercise the sovereignty of Turkmenistan; the people shall be the
only source of state power. The people of Turkmenistan shall exercise their power directly or
through representative bodies.
No part of the people, no organization or individuals shall have the right to appropriate power
in the state.
Article 4. In Turkmenistan, the highest value of society and the state shall be a person.
Protection, support of a person and service to him shall be the main tasks of state authorities.
The State shall be responsible to every citizen and ensure the creation of conditions for the
free development of the individual, protect life, honour, dignity, freedom, and personal
inviolability, natural and inalienable rights of a citizen.
Every citizen shall be responsible to the state for fulfilling the duties assigned to him by the
Constitution and laws.
Article 5. Turkmenistan shall be a state that guarantees the social security of every person.
