dismissal of the President of Turkmenistan from office. Such a decision shall be made by a majority of at least two-thirds of the total number of members of the Halk Maslahaty and by a majority of at least two-thirds of the total number of deputies of the Mejlis. In case of violation of the Constitution and laws by the President of Turkmenistan, the Milli Gengesh of Turkmenistan may express no confidence in the President of Turkmenistan. The issue of expressing no confidence in the President of Turkmenistan may be considered at the request of at least two-thirds of the total number of members and deputies of the Milli Gengesh of Turkmenistan. The decision to express no confidence in the President of Turkmenistan shall be taken by a majority of at least three-quarters of the votes of the total number of members of the Halk Maslahaty and by a majority of at least three-quarters of the votes of the total number of deputies of the Mejlis. The issue of the removal of the President of Turkmenistan from office shall be submitted to a national referendum. Article 76. The President of Turkmenistan shall have no right to transfer the exercise of his powers to other state authorities or officials, with the exception of the powers provided for in paragraphs 2, 15, 18 of Article 71 of the Constitution, which can be transferred to the Chairperson of the Halk Maslahaty. Should the President of Turkmenistan be unable to perform his duties for one reason or another, his powers will be transferred to the Chairperson of the Halk Maslahaty until the election of the President. In this case, the election of the President of Turkmenistan must be held no later than sixty days from the date of transfer of his powers to the Chairperson of the Halk Maslahaty. A person acting as the President of Turkmenistan cannot be nominated as a candidate for the post of President. Amendments to the Constitution of Turkmenistan cannot be made during this period. CHAPTER III. MILLI GENGESH OF TURKMENISTAN Article 77. The Milli Gengesh of Turkmenistan [Parliament] shall be a representative body exercising legislative power. The Milli Gengesh of Turkmenistan shall consist of two chambers - the Halk Maslahaty and the Mejlis. Article 78. The Halk Maslahaty shall consist of eight representatives from each welayat and the city of Ashgabat, who shall be elected by secret ballot at the meetings of the halk maslahaty of the welayats, the city of Ashgabat. Law shall determine the procedure for their election. The President of Turkmenistan shall appoint eight members of the Halk Maslahaty.
